Subscription and sales terms

Last updated:

These terms set out the general framework of the subscription and licence relationship between Akollo (“Akollo”) and the organisation that buys Akollo (the “Customer”). Where a signed order form or service agreement says otherwise, it prevails.

1.How a contract is made

Akollo cannot be bought directly on this website. Every sale starts with a demo and a quote for your organisation; the contract is made when the Customer accepts the quote by signing an order form.

The prices and the calculator on this website are for information. The binding price, number of users, deployment, term and add-ons are those in the order form.

2.Service and deployment

Akollo is offered in three ways:

  • Cloud: we host, update and back up Akollo.
  • Private cloud: an instance dedicated to the Customer, run by us in the region they choose.
  • On-premise: a term licence on the Customer's own servers, with updates and support included.

3.Term and renewal

Subscriptions run for terms of 1, 3 or 5 years; longer terms carry the discount stated in the order form.

Unless the order form says otherwise, a subscription renews for the same term unless either party gives written notice at least 60 days before the term ends. Renewals use the list prices then in force; we announce price changes at least 90 days before renewal.

4.Fees and invoicing

Fees are per user and, unless the order form sets another payment plan, invoiced yearly in advance for each term. Prices exclude VAT and other taxes.

The invoicing currency is stated in the order form.

5.Users and add-ons

Users and add-ons can be added during a term; the extra fee is invoiced pro rata for the rest of the term. A lower number of users takes effect from the next term.

AI on Akollo models is metered in AI tokens across the whole organisation and invoiced monthly after use. AI used with the Customer's own key or model carries no token charge.

6.Payment

Invoices are due within 30 days of issue unless the order form says otherwise. If payment is still missing after a written reminder, we may suspend the service until it is made; your data is not deleted meanwhile.

7.Service levels and support

Support and the availability commitment depend on the plan and are set out in the order form or the service level annex.

8.Data

Customer data belongs to the Customer. On cloud and private cloud, Akollo processes it on the Customer's behalf and instructions as a processor, as set out in the data processing agreement.

When the contract ends you can export your data for 30 days, unless the order form sets another period. After that the data is deleted, subject to legal retention duties.

9.Distance selling and consumers

Akollo is sold only to businesses, organisations and public bodies, for professional or commercial use. The right of withdrawal and pre-contract information rules for consumer distance contracts therefore do not apply to these sales.

If a contract turns out to have been made with a consumer, the consumer's statutory rights are unaffected; please contact us at [email protected].

10.Governing law

These terms and every order form are governed by the laws of the Republic of Türkiye. Unless the order form names another venue, disputes are settled by the courts and enforcement offices at Akollo's registered seat.
